NEW YORK – New York City’s schools have been temporarily blocked from enforcing a vaccination mandate for teachers and other workers by a federal appeals judge just days before it was due to take effect.

The workers’ mandate for the country’s largest school system was to take effect on Monday. But late Friday, a judge at the 2nd U.S. Court of Appeals granted a temporary injunction and quickly referred the case to a panel of three judges.

Education Ministry spokeswoman Danielle Filson said officials are seeking a speedy solution at the district court next week.

“We are confident that our vaccination mandate will continue to be upheld once all the facts have been presented, for that is the level of protection that our students and staff deserve,” Filson said in an email.

She said more than 82% of the department’s employees have been vaccinated.

While most school workers have been vaccinated, unions representing leaders and teachers in New York warned of still being able to leave 1 million student school systems on up to 10,000 teachers along with other staff, e.g. Cafeteria workers and school police officers.

New York Mayor Bill de Blasio has resisted calls to delay the mandate.
