Auburndale man arrested for fatally crashed in August – CBS Tampa

POLK COUNTY, Fla. (CW44 News at 10) – Traffic homicide detectives from the Polk County Sheriff’s Office arrested an Auburndale man on Friday, December 31, 2021, following the conclusion of their fatal accident investigation, which began nearly five months earlier.

The 26-year-old Sergio Ramirez-Padilla was arrested at his home and charged with DUI manslaughter (F2), driving while his driving license was suspended / summoned resulting in death (F3) and DUI causing property damage (2 points, M1).

The accident occurred on August 2, 2021, on K-Ville Avenue, east of Rowell Street in the unincorporated area of ‚Äč‚ÄčAuburndale.

The investigation showed that Ramirez-Padilla’s Ford Explorer crossed the center line and hit a 2008 Chevy Malibu head-on.

The driver of Malibu was 33-year-old Sean Rhodan from Lakeland. Mr. Rhodan died of his injuries after being taken to an area hospital.

Ramirez-Padilla also sustained some non-life-threatening injuries in the crash.
A third vehicle was involved in the accident as it hit debris from the other two vehicles, but there were no injuries to its passengers.

During Ramirez-Padilla’s treatment at the hospital immediately after the crash, blood samples were taken. These samples were tested – and these results were recently received by traffic homicide detectives and revealed that Ramirez-Padilla’s blood alcohol content (BAC) was 0.142 g / dL (grams per deciliter). The legal threshold is 0.08 g / dL.

“This arrest will obviously not bring the victim back; his family is still suffering a great loss. But I’m glad our detectives have completed a thorough investigation so that the responsible man can be brought to justice. This is a sad reminder, what can happen when people choose to drive while disabled, “said Grady Judd, sheriff.

During his first hearing, Ramirez-Padilla was awarded a total bail of $ 16,000.
