Da rep. Mary Miller (R-IL) on Wednesday asked President Joe Biden’s deputy secretary of education, Cindy Marten, if there are two sexes, Marten refused to answer.
The incident occurred during a hearing in the Education and Labor Market Committee, in which Miller questioned whether teachers and school staff could lose their jobs to pronounce the “biological and genetic fact that there are two sexes.” Marten repeatedly tried to redirect Miller’s questions before finally offering the congresswoman by saying, “Thank you for your questions.”
Here is the dialogue:
Miller: Deputy Secretary Marten, when Secretary Cardona testified before this committee, I asked him about the department’s guidance to school teachers that they could be charged with harassment if they say there are only two sexes, one man and one woman. I asked the secretary how many genders there are and he could not answer. Can you please tell me, “How many genders are there?”
Feels: Well, I’d rather talk about the greater value that our students can learn in –
Miller: But under your guidance, under your guidance, you say that teachers could be investigated for harassment if they state the biological fact that there are two sexes.
Feels: The most important thing is that all campuses—
Miller: Are you saying that teachers can lose their jobs because of this, but you can not actually say how many genders there are?
Feels: We do not make decisions at the local level about teachers, but what can I say –
Miller: It came from the Ministry of Education. This is not local. If it were local, I can assure you that ordinary Americans, including ordinary Democrats, are furious that the Department of Education is promoting gender identity education in schools. It is a fictional concept that will have significant consequences. Every human being is either a man or a woman. It’s a biological fact.
Feels: Thank you.
Miller: So you still can not say how many genders there are?
Mår: I can tell you that the department is committed to the safety of students and the rights of all students to access education –
Miller: But what about those teachers who teach biology or genetics and they say there are two sexes? Male and female. Your department’s guidelines state that they may be subject to investigation for harassment. What do you think?
Feels: And in the end, I know that –
Miller: I know you know it’s hard to come up with an answer that can satisfy parents in our country.
Feels: Thanks for your questions.
Miller: Yes, did you have an answer to that? Because teachers could lose their jobs because of this, over saying the biological and genetic fact that there are two sexes. It is your department that issues this guide. You make teachers vulnerable, and even students perhaps, who do not feel safe in locker rooms or bathrooms, and they go in and communicate it to maybe a principal or a teacher; perhaps they will then be accused of harassment. This has really had significant consequences, so I hope next time you can tell us how many genders there are. Thank you and I will give back.
Miller specifically referred to a June 2021 note issued by the Biden Department of Education around the time the Biden administration announced that Title IX protection would be extended to cover transgender students in schools that accept federal funding. In the note, entitled “Confronting Anti-LGBTQI + Harassment in Schools,” the Ministry of Education lists examples of types of incidents in the Civil Rights Division’s (CRT) Education Opportunities section of the Department of Justice and the Office for Civil Rights (OCR) at the Ministry of Education.
A few examples of “the kind of incidents CRT and OCR can investigate” include [emphasis added]:
- When he starts middle school, a transgender boy introduces himself as Brayden and tells his classmates that he / she uses pronouns. Some of his former classmates in elementary school “send” him to others, and every day during physical education calls him transphobic spells, pushes him, and calls him by his former name. When he reports it to the school administrators, they reject it and say, “you can not expect everyone to agree on your choices.”
- An elementary school student with intersexual traits dresses in a gender-neutral way, identifies as non-binary and uses pronouns. The student’s teacher laughs when other students ask if they are “a boy or a girl” and comments that “there is only one way to find out.” The teacher tells the class that there are only boys and girls and everyone who thinks otherwise has something wrong with them. The student tells an administrator who notices “you need to be able to laugh at yourself sometimes.”
- On the way to the girls’ toilet, a transgender high school girl is stopped by the principal, who locks her in. The principal asks the student to use the boys ‘toilet or the nurses’ office because her school journal identifies her as “man.” Later, the student joins his friends to try out for the girls’ cheerleading team, and the coach rejects her from rehearsals solely because she is transgender. When the student complains, the principal tells her “these are the district’s policies.
When Miller had finished questioning Marten, the far-left member called Rep. Ilhan Omar (D-MN) Miller’s questionnaire “nonsense” and praised Marten for her ability to “stay the course.”
Miller told Breitbart News exclusively that Omar’s insult was empty and still does not provide evidence that there are in fact more than two sexes.
“I would ask her the same, very simple question. How many genders are there? They claim our questions are junk, but when asked, they have no answer,” Miller said via email Friday.
Miller, as to no avail previously questioned the ministry’s position on gender, Marten said, refusing to respond because “the Biden administration certainly recognizes that their radical ideology is not supported by the American people.” She further argued that this is another area where the government is trying to overtake the role of parents.
“The danger is that teachers will be prosecuted and even lose their jobs. Confused children become restless and bullied. “Parents are losing control of their children’s education and are unable to support their children and protect them from indoctrination in the workplace,” Miller said. “It already affects students, teachers and parents; look at the father who was arrested in Loudoun County for trying to protect his daughter and other school children from being assaulted by “transgender” mentally ill children. It is time for parents to regain control of their local school boards. ”
Just a few months ago during a budget vote, Democrat John Yarmuth (KY) said the government knows better than parents when it comes to vaccinating children against the Chinese coronavirus, after Miller proposed legislation requiring schools to catch up with parents or guardians consent before vaccination children.
He said in opposition to the amendment:
I know I’ll get in a lot of trouble for this, but I would like to refer to the sponsor’s premise for the amendment, and the first words from her mouth were, “parents know what’s best for their children.” I think the evidence is compelling and overwhelming and widespread that they do not.
That is what the House Democrats think @RepMaryMiller is wrong when parents know what is best for their children.
Instead, Democrats say “we should protect children from their parents.”

Another team member, rep. Pramila Jayapal (D-WA), went so far as to call the proposal “nonsensical” and expelled people who refuse to follow the “science” of masks and vaccines. The Education and Labor Committee ultimately opposed the amendment along party lines. The change has not yet gone up for an official vote to be included in the Democrats’ $ 3.5 trillion budget vote, which serves as a left-wing wish list.
Miller said “absolutely” when Breitbart News asked if Democrats have the same attitude that parents do not know best for their children when it comes to gender ideology.
“I believe in parental consent. It’s time to speak out against indoctrination and child abuse,” she said. “No school or government should give consent on behalf of children in any case. Believe it or not, children across our nation get the vaccine without parental consent! Giving power back to parents should be a priority for Congress. “
Parents have mobilized across the country in opposition to the government’s excessive efforts in schools, particularly in terms of vaccine and mask mandates, critical race theory and gender ideology. In fact, in July, there had been more recall efforts from school board members in 2021 than in any year since 2006. The rejection of vigilant indoctrination in schools manifested itself on the national stage when Republican Glenn Youngkin won Virginia’s gubernatorial run on November 3rd. Voters across all demographic groups went to the polls to prevent Democrat Terry McAuliffe from becoming governor after Youngkin specifically campaigned to empower parents.
Miller agreed with many of her GOP colleagues when asked if Youngkin’s victory could be a warning of a “red wave” in 2022.
“I think it’s safe to say that Youngkin’s victory gave parents the energy to stand up to a vigilant ideology in schools. Glenn Youngkin sent a clear message to government bureaucrats: Treat parents with more respect,” she concluded.
